The Oscar Pistorius trial has resumed following a month long break. During that time, Pistorius underwent a psychiatric evaluation at the direction of the court to determine if he suffered from general anxiety disorder (GAD) at the time he killed Reeva Steenkamp. The Charges The issue being determined at trial is whether Pistorius killed Steenkamp intentionally, or as Pistorius alleges, he killed her by accident believing her to be an intruder. Form a legal standpoint, this distinction is really important since it ties into the charges faced by Pistorius. There are three possible scenarios with respect to the charges: Premeditated murder, murder and culpable homicide. Premeditated murder requires an intent to murder plus planning the murder. Premeditation is reserved for more robust planning and generally doesnt capture an intent that materialized right before a crime was committed. There was no significant planning to the crime, so premeditated murder will likely fail. Even if the prosecution cant make out premeditated murder, it can still get Pistorius on the lesser charge of murder. In order establish murder, they only need to show that he intended to kill Steenkamp (no planning element needed).Should the prosecution fail on murder, there is another lesser charge that could come into play: culpable homicide. This charge means that Pistorius negligently killed Steenkamp (or that he killed her by accident). Premeditated murder would get Pistorius a compulsory life sentence, while murder would result in a compulsory sentence of 15 years. For culpable homicide, the sentencing is discretionary (varies from fines to prison time), although its not unusual to see prison time in South Africa of 5-10 years for this type of crime. Facing very serious charges, the defence team wanted to establish that Pistorius should not go to jail because he was mentally ill when he fired those four gunshots the night of Valentines Day. And thats where GAD comes into play. General Anxiety Disorder And Diminished Capacity A defendant that suffers from a mental disorder can be found not criminally responsible on the basis that he or she could not appreciate the difference between right and wrong at the time the crime was committed. If such a finding is made, one possible outcome is the trial ends right then and there, and the defendant is committed to an institution indefinitely. In essence, it would look very much like an acquittal with ongoing psychiatric care. So if it was concluded that Pistorius had a mental disorder that made him incapable of appreciating the wrongfulness of his act, the trial could have come to a very abrupt end and Pistorius could have avoided jail time. Psychiatric Finding The psychiatric report concluded that Pistorius was not mentally ill at the time he killed Steenkamp. As per the report, "at the time of the alleged offenses, the accused did not suffer from a mental disorder or mental defect that affected his ability to distinguish between the rightful or wrongful nature of his deeds". So that means the trial continues and Pistorius does not avoid prison in favour of an institution. Mental Illness No. 2: Post-Traumatic Stress Disorder Things didnt end with GAD. On July 2, the defence team declared that Pistorius was suffering from post-traumatic stress disorder (PTSD) and as result was suicidal. "He is...mourning the loss of Ms Steenkamp," said Barry Roux, Pistorius lawyer. "Should he not receive proper clinical care, his condition is likely to worsen and increase the risks for suicide." Is this a meaningful finding with respect to exonerating Pistorius? No. This mental disorder speaks to Pistorius state of mind AFTER the murder and not before or during the act. The key is in the name of the affliction: POST-traumatic stress disorder and not PRE-traumatic stress disorder. So that means that even if it can be shown that Pistorius suffers from PTSD, his mental illness did not render him unable to appreciate the difference between right and wrong at the time of the killing since he would have only developed the illness after the crime. Accordingly, as far as being a defence to the core issue in this trial, namely that Pistorius did not intend to kill Steenkamp, its irrelevant and of no import. However, the defence team may have raised PTSD as further evidence that Pistorius did not intend to kill Steenkamp. The defence team would argue that Pistorius is distraught to the point of being suicidal because he never intended to kill Steenkamp. If he did intend to kill Steenkamp, he would not be suicidal. Of course, this argument is vulnerable to attack. Pistorius intending to kill Steenkamp is not incompatible with feeling profound remorse and guilt after the fact. Indeed, it could be argued that experiencing feelings of anguish and accountability after intentionally killing someone is not unusual in this type of circumstance. The defence team also raised PTSD so they could rely on it as a possible mitigating factor to reduce his prison time come sentencing. The idea would be that he would need ongoing psychiatric care, which could only be adequately provided in an institution outside of prison. Next Steps Once the defence has called all its witnesses, it will close its case. That should within the next week or so. After that, both parties will present their closing arguments with a view to persuading the court of their respective positions. Once closing arguments wrap up, the Court will schedule a date to announce the verdict. Following the determination of guilt, a sentencing hearing will be held where both sides will present arguments with respect to the appropriate sentence. Thereafter, Judge Masipa will hand down her sentence. At the rate the trial is proceeding, expect it to conclude sometime in mid-summer. Pistorius claims lack believability and veracity. Hey, just in time for Smiths big homecoming. Smith and the Chiefs try to win a third straight game on Sunday as the former top draft pick makes his return to San Francisco to battle the 49ers at Levis Stadium. Smiths first game against the franchise that drafted him first overall in 2005 has overshadowed a recent hot stretch by the quarterback and the team. Kansas City avoided an 0-3 start by rolling past Miami 34-15 on Sept. 21, then routed the New England Patriots 41-14 this past Monday night. In those two wins, Smith has completed 76.5 percent of his passes and thrown for six touchdowns. He posted a 144.4 passer rating in the victory over the Pats. None of this surprises his former Niners head coach Jim Harbaugh. You know, I have never seen Alex Smith not be good. Right from the time we were with him, how hes playing now. Hes just always been a very good quarterback, noted Harbaugh. Smith was San Franciscos starting quarterback when Harbaugh took over head coaching duties with the franchise in 2011 and the duo made it to the NFC Championship game, where they suffered a loss to the New York Giants. The Smith-led Niners got off to another fast start the following season, with the signal-caller his normally-efficient self over a 6-2 start. However, he suffered a concussion in a tie versus St. Louis in Week 10 and Colin Kaepernick made the start the following week, leading San Francisco to a win over the Chicago Bears. Kaepernick never gave up the job and helped San Francisco reach the Super Bowl, where the club suffered a loss to the Baltimore Ravens. Smith was traded to Kansas City during the offseason for two draft picks. Smith helped the Chiefs return to the postseason last year and signed a four- year extension this past offseason. Obviously his first game back in San Francisco would make headlines, but the 30-year-old is more concerned with getting a win. I could care less about the stats and out-dueling anybody, said Smith. And I guess the thing that Im talking about is I know that this is going to be a story and I have to deal with it. Yeah, and going back there and playing against some of those guys that I played with. At 2-2, both the Chiefs and 49ers are third in their respective division. WHAT TO WATCH FOR Smith will look to be extra precise in this game, a trait that led to him throwing for 14,280 yards and 81 touchdowns in 75 starts with the Niners over eight seasons from 2005-12. In his last three games, Smith has completed 69.9 percent of his passes and has not been intercepted. That gives the signal-caller a 112.7 passer rating over that span, but Harbaughh doesnt expect his former quarterback to just play it safe this weekend.dddddddddddd Not an accurate term. Hes a football player, Harbaugh said when asked if Smith is simply a game manager. Smith was helped on Monday night by the return of running back Jamaal Charles from a sprained right ankle and the play of tight end Travis Kelce. Charles ran the ball 18 times for 92 yards with a score and also caught a pair of touchdown passes, while Kelce set career highs with eight catches for 93 yards. He also caught a TD pass. Kansas Citys offense thrives when Charles touches the football, either on the ground or in the passing game. Hes a unique player and obviously extremely talented and can do so many different things. ... When you have a weapon like that, you can do run and pass and mix it up, its obviously extremely helpful, said Smith. Smith and Charles go up against a Niners defense that ranks second in total (287.3 yards per game) and run defense (69.8 YPG). San Francisco held Philadelphia to only 22 yards rushing last weekend, the ninth fewest allowed in a single game in franchise history. The 49ers have yielded just 152 total rushing yards over the past three games despite missing linebackers Navarro Bowman and Aldon Smith. Linebacker Patrick Willis leads the team with 23 tackles and defensive tackle Justin Smith has three sacks on the year as well as five over his past seven games. Their front seven is a tough unit, noted Chiefs head coach Andy Reid of the Niners. Big physical guys, the linebackers can run. I would say that their defense is one of the top defenses out there right now. So we need to make sure we prepare for a good bunch of players there and thats what well do. Kansas City has had its own success on defense, ranking eighth against the pass (221.5 YPG) and eight in points allowed (19.8 PPG). The Chiefs are one of just two teams to not give up a rushing touchdown this season and had three takeaways versus the Patriots, including a pick-six by safety Husain Abdullah. Linebacker Justin Houston had two sacks versus New England and became the second-fastest player in team history to reach 30 for his career. He did so in 47 games, behind only Hall of Famer Derrick Thomas, who hit the plateau in 31 games. While Kaepernick is engineering just the leagues 22nd-ranked pass attack, the Niners are rushing for 138.5 yards per game and will try to maintain that success this weekend. Running back Frank Gore totaled 119 yards on 24 carries versus the Eagles, but also caught a 55-yard touchdown pass from Kaepernick. Kaepernick himself ran for 58 yards, marking the first time in his career he has run for 50-plus yards in three straight games. That is one thing that perhaps separates him from Smith, but Harbaugh wont rate the two against each other. Never been a big fan of comparisons. Colins play has spoken for itself, he said. San Francisco is hoping to have two key pieces of its offense for this game. Right tackle Anthony Davis made his season debut versus the Eagles, but left late in the first quarter with a left knee injury, while talented tight end Vernon Davis was forced out in the third due to a back injury. Neither practiced on Wednesday and their status is unknown. OVERALL ANALYSIS There is a lot of similarities between these clubs, with the Chiefs perhaps having the slight edge on offense and the Niners possessing the better defense. Does that make the Smith-Kaepernick battle the x-factor? If so, Smith will need to make sure he sticks to what he does well and doesnt try to do too much versus his former team. You focus in on what you do. All the distractions, going home and all that -- it doesnt mean anything, said Reid. Youre there to play the game and once youve said hi to your buddies its over. Youre playing the game, thats what youre doing. San Francisco showed a little Smith influence versus the Eagles by holding the ball for just over 42 minutes in the game, but the Chiefs move at a much slower pace than Philadelphia. That means mistakes must be kept to a minimum and that should give Smith the edge over the flashier Kaepernick.
